Slight variations in color, density, and wave pattern are inherent to the nature of high-end hair systems and do not constitute a product defect.

 

Professional Use and Maintenance: Our products are professional-grade hair systems that require specific care. Celeste is not liable for damage resulting from improper handling, unauthorized chemical processing, excessive heat styling, or the use of non-approved adhesive products. We strongly recommend that any technical alterations, including cutting or coloring, be performed by a certified professional. Failure to follow the provided Care Guide may void any applicable claims.

 

Warranties and Guarantees: To the maximum extent permitted by law, we provide our website, products, and boutique services on an “as is” and “as available” basis without any warranties, representations, or guarantees, whether express, implied, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Health and Sensitivity Disclaimer: It is the client’s sole responsibility to disclose any known allergies, scalp sensitivities, or medical conditions prior to the application of any hair system, adhesive, or clip. Celeste is not responsible for any allergic reactions, skin irritations, or hair loss resulting from the use of our products or services.

 

Limitation of Liability: To the fullest extent permitted by applicable laws, Celeste and its affiliates disclaim liability for any injuries, losses, or damages of whatever nature arising from: Personal injury or scalp irritation resulting from product use; Damage to the product caused by third-party stylists or improper maintenance; Loss of data or damage by virus; Claims of third parties; Physical injury or property damage occurring within our boutique premises.

 

Section 6. SECURITY & INDEMNIFICATION

Transmission of information over the internet is not fully secure. Any transmission is at your own risk. Nevertheless, if there is a security breach on behalf of an unauthorized party, you agree to indemnify us and hold us harmless for any and all claims against the unauthorized party. We strive to prevent the introduction of malware, malicious code, and viruses. However, we are unable to guarantee or warrant that our websites, products, content or other Services are completely free from viruses. Your use of our website, products and Services is completely voluntary. As such, you shall indemnify us and hold us and our agents and affiliates harmless for any damages or injury that may arise from your use of our website, products and Services.

Section 8. INTELLECTUAL PROPERTY & STOCK PHOTOGRAPHY

Stock Photography: This website may use free stock photography as part of its design. All stock images used have an irrevocable, non-exclusive copyright license to download, copy, distribute, use and modify the photos for free. Intellectual Property: This website, content and products contain intellectual property owned by us. Examples include, but are not limited to: trademarks, service marks, layout, logos, business name, design, text, written copy, and all of our paid products. You shall not copy, publish, transmit, transfer, sell, create derivative works from, reproduce, or in any way exploit any of the Intellectual Property in either whole or part without prior written consent.

 

Section 9. REFUNDS & LICENSE

Refund Policy: Due to the intimate and bespoke nature of our products, and in compliance with health and hygiene standards, all sales are final. Custom Couture Pieces are non-refundable once production has commenced. Ready-to-Wear Collection pieces cannot be returned once removed from original packaging. Boutique Services fees are non-refundable.

Limited License: We grant you a limited, personal, non-exclusive and non-transferable license to access and use our website for the purpose of shopping and booking services. You shall not copy, reproduce, transmit, modify, edit, or create derivative works for commercial use.

 

Section 10. MISCELLANEOUS

Amendments: We reserve the right to amend this Agreement from time to time.

 

Headings & Severability: If any portion of this Agreement is held to be unenforceable, it shall not affect the remaining portions.

 

Entire Agreement: This Agreement reflects the entire agreement between the parties and trumps any other existing negotiations or communications.
